folks in virginia and on the coast. we are live on the north carolina outer banks. >> but first starting with janis dean in the weather center. is the worst over? >> almost. it has been downgraded to a category one. it made landfall with 100 miles per hour. it is moving quickly at around 23 miles per hour to the northeast. it is going to get on this accelerationing -- acceleration path over the next 24 hours. the storm is going to continue to move north and eastward. cape cod is one area of concern with eastern massachusetts.

we will still see blustery conditions and just because the storm is offshore doesn't mean we will not feel the gust, storm surge and rough beach with rip currants. people need to be out of the water. let look at the peak wind gust when the storm was at its strongest. cape lookout where it landed at 101, cedar island 88. this is the strongest hurricane landing since 2008. it has been a hurricane drought. this one brought us back to reality that we are in hurricane season. continues to move northeast. cape cod and the islands here where we could see tropical storm force winds and potential for showers and it is moving into cooler water.

we had a gulf stream here that intensified the storm to a category two and now it is getting into cooler water. it is going to become extra tropical. still a very strong powerful storm coming close to cape cod and the islands into eastern canada. the winds are coming down, pressure is going up and a weakening storm and it is moving offshore. >> a wet fourth of july were a lot of people out there. thanks, janis. tens of thousands are without power in the carolinas. let's go to jonathan who is in kill devil hills. what are conditions like flight? >> reporter: i am experiencing exactly what janet described. blustery conditions and you can see the churning waves here.

dare county authorities have no reports of injuries and they want to keep it that way so they are advising people to stay out of the surf. >> what about damage? how are things looking now the sunt? it hit in the middle of the night. >> reporter: authorities are going out to look for damage. the photographer will pan over and in our immediate area we are not seeing structural damage. but if you go else where on the island there are reports of shingles being torn off the building further south there are more problems. authorities are still restricting access to haterous island and there are reports to damage, including highway 12, but the north carolina dot said their crews are having a hard

time getting in because of flooding. not from overwash from the ocean but flooding from the sound the large body of water on the other side of these communities. >> we will check back in in a little bit. and more images from hurricane arthur coming in. drivers are having to navigate around debris and storm surges that took this road off the road here. more storm surge in this picture. this car has about two feet of water. and police were out in force monitoring closed roads that were flooded and trying their best to keep the drivers out of the most dangerous areas. you do want to stay with us all morning long. we are going to be watching hurricane arthur's path up the

east coast and the damages left in the wake of it. in other news, the pentagon is now grounding its entire fleet of f-35 fighter jets ordering additional inspections of the single-engine planes. there was a fire on a runway last month at a florida airforce base that forced the pilot to a abort the take off and the cause of the fire is unknown. elizabeth pran is live. what caused the fire or caused the grounding after the fire? >> reporter: well the pentagon f-35 program office announced the suspension for both the air force and navy after it caught fire in northwest florida. the statement reads the root cause is under investigation and additional inspection of f-35 engines have been ordered and

return to flight is based on the results of the analysis of the data. the grounds has happened a number of times. >> elizabeth, there has been a lot of controversy over the f-35 program with a huge expense and talk about the engine. any history with who made this engine having the problem? >> reporter: while the aircraft is designed by lockede martin the engine is made by prad and wh whitney and they wrapped up the highest tab in history. many people pushed for general electric but the administration wanted to trim the budget and

pushed for this engine solely. this occurs as the overall bill for the program is around $398 billion. >> and the hits keep coming on the f-35. thank you. irs attorneys maybe working this fourth of july as they get ready for a busy week ahead. top lawyers are making two separate court appearances facing which -- the -- challenges of the week ll lely e-mails. now this is going into a courtroom next week, is this is moment where the irs is going to have to fork over the documents and information in front of a

judge? >> reporter: a judge will decide if outside experts can look into the irs system and figure out how the e-mails were lost if they were lost or how the system crashed. the irs doesn't outside experts coming in because they don't want unknown people looking at the files. but i think we need to clarify what happened and this is necessary. >> what about the doj in all of this? they have been conducting an investigation. critics say the doj has done nothing to help in unveiling these e-mails. can't congress do something about that? can't there be more calls?

>> there will be but the doj is held by eric holder and he is an obama follower. if the head of the doj says there is no corruption and president obama don't believe there is corruption what is there to look into it? first they need to acknowledge maybe something possibly went wrong here, which the department of justice and president obama don't seem ready to acknowledge, and then there will be an investigation. but the justice department isn't forthcoming and isn't cooperating with the republican-led representatives. >> a houston group is in the middle of this now and it will be a busy week unfolding next week. as we have been talking about the last couple days, shocking new developments in a traging case that shocked the nation where a toddler died in the back of the hot car and disturbing details about the

the scandal at the va isn't stopping top officials getting bonus. hello, congressman. more than $380,000 in extra pay was awarded to executives at 38 hospitals where investigators are looking into claims of falsified records to hide delays in patient care. the bonus were part of $2.7 million given to top officials at the agency. leland yee? >> turning now to the crisis along our southern border and what can be down to slow the flow of thousands of children

would be coming. when you see kids laying on concrete floor and thousands of people and 18 people with scabies behind the crime scene tape. this is preventable and this administration caused it. they can stop it. and for those saying it would be terrible to send the national guard, well woodrow wilson did that and he secured the border >> you believe we can put the dike back together and repair this? >> spent a weekend out there all hours of the day and night. the border patrol doesn't want to go on record. but they are saying this isn't new. we had a flood of people coming from brazil because they heard they will not be sent back.

>> why isn't the administration doing it if it isn't so simple to solve? >> they created the crisis and they knew they were creating it. they are overwhelming the border. >> what is the political end game? >> they are hoping to create thousands of millions of new voters and overwhelm the system. it is what they have been doing >> you think it is that simple of a political calculation? >> there is a lot more involved but that is what is happening. if you say anybody in the world that is related to me can come live in my house and people start flooding in before long you don't have enough to cover your own family much less everybody flooding in. that is what is going to happen if we don't stop this. >> the president is now in the position of having to ask congress for money on one side and demanding action from the

other side. do you get a clear and understandable immigration policy from the white house? >> no. and that is the danger. the president said he is not following the law and he is not. we are saying until the president will follow the law and security the border there is no sense in doing reform. and leland once he shows he will secure the border you will be amazed how quickly he is going to get immigration reform. you cannot do it with a lawless president. he will throw out the parts he doesn't like and enact the ones he likes. >> it is a certainly a crisis of many feelings. the one thing that has been dog dogging the whoite house is the scandal at the irs. and you put up a bounty of a million to find them.

the world cup isn't over and there has been a deadly construction accident. an overpass collapsed on to a highway crushing a bus and several cars. at least two people were killed and ten others injured. witnesses say it collapse felt like an earthquake. it was two miles from the stadium where a semi final cup will be played next week. well the georgia man accused of leaving his son in a hot car to die would case the death penalty. justin ross harris said he accidently left his 22-month-old son in a blistering car and he later died. but prosecution says harris did it on purpose and was cheating on his wife while his son was dying >> he was having up to six different conversations with

lose based on the testimony. when the wife finds out her baby baked to death in a car -- not a tear, her own mom said why aren't you crying? she goes to visit the dad in jail. one of the first thing she says on the evening that her kid died, she sees the dad, and says well did you tell him too much? very odd behavior. and also the very strong part of the state's case is they prove intent and have a strong suggestion of motive. financial motive. $27,000 on a 22-month-old. >> highly unusual. >> and then to have it witnessed in court that the police found that he was searching how to

live without a child? how could he not get first degree murder? >> this is what you called hunch justice. you have a hunch they plotted to kill their 2-year-old and you have a hunch they had a financial motive. this man has no prior history of depriving or hurting a child. he doesn't fit the bill. this guy has what i think is called deminished capacity and he as a sex addition. >> that isn't a murderer charge. >> this is neglect not murder. >> brian, having a sex addiction doesn't mean you are a murder. >> that is not what i said. i said it doesn't prove you plotted to kill your daughter. this man was so distracted -- he

we have a fox news letter. new violence in jerusalem. you are looking at live pictures from jerusalem. israeli police clashing with palestinian protesters as an arab teenager who was abducted and killed earlier this week is laid to rest. it coicoincides for the start o rom dawn. what is going on, david? >> reporter: grief combined with frustration has led to violence.

this is a street in east jerusalem not far with the 16-year-old palestinian boy was laid to rest. you can see the clashes unfoldi unfolding. about one city block from here you can see a hundred palestinians who have set fire to a tire and throwing rock and a cock ptail was fired and the police are using tier gas and stun guns. it could go on for a few more hours. a great deal of uncertainty on what caused the death of the 16-year-old palestinian. many believe it was pay back for the three teens that were killed.

israelis say there is no known motive. one possibility is we could see the situation improve in just a few hours -- you can see the rockets coming in. some of them landing at our feet literally. in just a few hours time, the palestinians will be having their meal to end their fast for their rom dawn and that could contribute to a lessening of the hostilities and the world cup game is going to be played so it is possible they might be distracted by the world cup. but the conflict here at this hour continues and cheryl i don't know how much of this you can make out from where i am standing. you can see a dumpster flying here. east jerusalem is the green flag of hamas and just a few feet to its right is the palestinian

challenging them in the courts. the president got rebuked 9-0 that he acted unconstitutional with the appointments to the mrlb. that sets up john boehner nicely in his attack with the president which will rock the president and the court will be forced to rebuke the president as ov overreaching authority. >> are the democrats or the white house worried about this? >> no, i don't think most legal experts think is going anywhere. but i think it is a show by speaker boehner that he is going to fight the president until the end. but this congress, the president's declining poll numbers, look at the congress. they are not close to having the president's approval number. the president sees the american people in terms of the economic

interest with the highway trust form and the lack of immigration not being attended to by congress. i think the white house and president see this as an opportunity to remind americans while the congress refuses to do anything he is in action. that is why he said so sue me because he's doing something. >> take for a moment the politics out and go into analysis mode. is this where the white house wants to be teeing things up for the midterms is this playing more into republican hands? >> our base is excited when the president abuses authority because he is inviting trouble. and i don't think many democrats are happy with the president's overreach and demeanor and wish he would cool down the rhetoric. >> let me quickly say on the democratic side ung i think

touting what he says is the recent strength of the job market. it is down 2/10ths from last month but the real unemployment rate is 12.1 percent for people who are working part-time. joining me now is the republican governor of ohio. it is great to see you, sir. happy fourth of july. your state, number one job creator in the midwest. you have the lowest unemployment rate in seven years. president obama said we should be doing a victory lap because of the job situation in the country. do you agree? >> we are glad to see the improvement for this quarter because a couple quarters ago it did shrink. despite anything coming from

washington, the job creators and entrepreneurs move forward. the problem is there is too much uncertainty, giant deficits and the problem with obamacare and employers not knowing what to do. we should be growing over a long period of time. i don't see it happening but i hope and pray because when people get jobs they have greater dignity and more sense of purpose. that is what america is about. getting people jobs and helping families. there is too much uncertainty out there but good news for this last quarter. >> governor, let me ask you about this. it seems like the president and democrats as well are kind of saying two things. it is a mixed message. we heard in the sound byte things are great but then the president went on to admit we don't have wage or income groat

growth. people are making the same amount of money as years ago ora lot less. how are the democrats able to say both things? >> i think it is a challenge for the country. not just democrats but republicans as well. we have had growth here in ohio above the natural average but we are seeing people that worked in the middle class jobs and those jobs are gone. but we can provide opportunities as long as people are being educated and getting skills, new jobs are emerging but it is a challenge for all of us because we want to be unified. >> governor, if you look at the unemployment rate of may of 2014, 5.5%. it was at 6.9% in january.

how did you make that happen, governor? >> well, look what we have done in ohio is something that the whole country are learn from. cut taxes, running budgets, common sense regulations, training workers and we have good education. all of those things together contribute to success. it has been blocking and tackling. not big government. but getting back to the basics of what makes america great and that is you reward people who work hard. those things worked in ohio and it is good we are doing better but we have a ways to go. >> great things to talk about as we celebrate the fourth of july across the country. i have to run. it was great to see you. >> may the fourth be with you. >> also with you, governor.

[fireworks going off] americans getting ready for fireworks all over the country and in new york city preparations are underway for two big shows. one has the statue of liberty has a backdrop. and now we are getting at a look at how it all comes together. carefully would be the first word. brian has more in lower

leland: arthur makes landfall? north carolina. cheryl: 100 mile-an-hour winds whipping outer banks. of the conditions are improving. but now the first hurricane of the atlantic season bringing 4th of july washout for parts of the northeast. welcome to brand new hour of "america's newsroom." i'm cheryl casone. good morning. leland: i'm leland vittert. bill and martha have this july 4th off. cheryl has been here since 4:00 a.m. you know about arthur. the storm weekended to a category one hurricane but severe weather watches and warnings remain in effect from virginia all the way up to coast to maine this holiday weekend.

the governor though of north carolina is praising the people there for keeping each other safe. >> this has been actually a very good day. there have been know casualties or serious injuries reported. that was our number one goal. that put as big smile on all our faces of the we haven't got all the reports in but things look quite good throughout the coast of north carolina. leland: cheryl: we've got team coverage for you. meet roll exist janice dean live from the fox weather center. let's go to peter doocy live from national head, north carolina. peter, now that the sun is up what does the damage look like? >> reporter: the biggest problem with nags head and outer banks are the roads. arthur brought a strong storm surge, four 1/2 feet on outer parts of the outer banks and some neighborhoods are threatened by water. these are not puddles.

some main roads run alongside the sound are submerged as well. this may be a sign of the times since this is the first hurricane of the 2014 season. emergency officials are telling people on social media and go online and check traffic cameras on the internet to see if the route they want to take between a and b for them today, is underwater. we were clicking around. some of those routes are underwater. some of them are not. those crews are working very quickly now that the sun is kind of off, at least obscured by clouds. there is light. crews are figuring out quickly what kind of damage to infrastructure and roads there are right now. they obviously don't want residents or businesses to miss another day what is normally the busiest time of the year but they also want people to be safe. cheryl? cheryl: peter doocy. peter, thank you so much. leland: for more on where hurricane arthur is right now, and probably more importantly where the bad weather is headed

for this holiday weekend, janice dean is live from the fox weather center. janice is there anyone on the eastern seaboard who will not get wet? >> we'll get wet, a little bit of wet from arthur but not too much. we actually have -- we saw really nasty storms across the northeast last night, that is what is going to push this storm offshore which is great news because this is still impressive-looking hurricane. on the satellite presentation we'll see those outer band moving towards chesapeake bay, up towards new jersey and long island and cape cod and island off eastern massachusetts needs to pay attention to the track but otherwise, you know a much quieter weather pattern into the weekend. i was looking at this. this is really good thing this storm is not pushing more to the west because we would be dealing with a beast of a hurricane across the northeast. so the bulk of the storm sitting offshore. however we'll watch certainly long island, cape cod, nantucket

, up toward new england and eastern canada needs to deal with a extra tropical event. the storm will lose its tropical characteristics and become almost like a nor'easter with very, very strong hurricane force wind. that is the latest track, category one. mainly offshore. still will feel battering waves and wind and rain as some of those outer band continue to sweep acrossland all up and down the northeast coastline. then, as we get into the weekend a much improved forecast. there is your rainfall. it was, we're still not out of the woods. we could see passing showers across the atlantic up toward the northeast a bulls eye here eastern massachusetts and maine. tomorrow, much better forecast. stay out of the water because things will be dangerous. leland: janice dean, fox emdream weather center. >> or the.

does the white house from your sense or reporting have a comprehensive policy or just kind of winging it by the seat of their pants and as the immigration, issue the crisis on the border has gotten more out of control? >> this white house always tries to, takes some real chutzpah on josh ernest's part talking about how rick perry is playing politics. rick perry is playing politics to certain ex-extent. but this white house tried to use any event possible to move its political agenda across. after they called usama bin laden, jay carney came out said this is proof why president obama needs to pass immigration reform as if that wasn't a nonsequitor. the push for comprehensive immigration reform, i'm sure there are problems and problems need to be fixed but a huge part is driven by election year politics. they want to secure the hispanic vote, the minority vote. idea somehow president obama is above the fray and only wants to deal with serious public polish

the book sold hundreds of thousand of copies over revealing details about the operation. the pentagon is now seeking royalties, arguing quote, the department continues to assert forcefully that mark owen breached his legal obligations by publishing the book without prepublication review and clearance. bill cowan, retired marine corps lieutenant colonel and fox news military analyst. bill, do they have a point here? >> well, cheryl, this is such an interesting story on many levels. let me say first if i may he was a former navy seal, not a marine and in that special operations community which is actually where i came from although not a seal, you typically do not talk about missions that you have been on. you are shunned by the community when you do that. he is being shunned by his own community but this is interesting also because it has taken the pentagon two years to decide to do this. one of early criticisms about his book was it probably had classified information in it. i don't know that it did.

i haven't seen any criticism coming out that it actually did. the fact of matter, the american public rivetted to this epic moment in american history, the killing of bin laden, the americe never heard the whole story had this book not been written. this is such an interesting story. cheryl: what is so interesting, if you think about it, we all watched the "60 minutes" broadcast was disguised and everything. the book just, you know -- we're in a new age. if this happened 20 years ago, bill, i don't think any of the details came out so quickly. this is the digital age. information is happening second by second. is that part of the story here? or do you think that the pentagon really is concerned about national security in that, terrorists overseas are going to get a better window how we operate in the middle east when we're trying to come after them, the bad guys? >> sure. i love of the fact that you answered, that you asked me that question because the fact of the matter is, it was this administration who leaked the name of the pakistani doctor who

helped us confirm that bin laden was in that compound. this administration leaked his name and he is in jail in pakistan for 33 years. this administration leaked the fact we had worked on the stuxnet program, cyber program with the israelis to attack the iranians. this administration are the ones that leaked information about a very classified counter terrorist operation in yemen that we were running in conjunction with the brits and saudis. this administration had a big mouth for a long time on leaking classified information whereas this book may or may not have any classified information in it but i haven't seen anything that said it does. and indeed in this digital age i think one of the good things about this book was, it allowed, because of the great interest and probably a million copies sole by now, either in hardcover, soft cover or ebooks, it led a lot of people who were interested, see what it is, what it takes to become a seal. all the work that they do, this young man and others go through.

cheryl: how they risk their lives, what they do, and also they risk their lives and dedication it takes. i had a friend went through seal training and he broke his ankle. he was out. it is incredible. what it takes just to get there. we were showing the book cover. one of the fascinating things they're going after royalties. if you want to figure out a way to prosecute the guy, fine. but to go after him financially, that surprises me a little bit here. >> that's, i love that point too. what is it they need? they need the million dollars that the book may get? what is it the government is after? maybe they're after him because his story doesn't comport exactly with the white house story. the fact that his story which is probably a lot truer than what the white house has to say is enough to rankle people in the white house and say, okay, let's go get this guy. apparently they can't get him for divulging classified information so let's get him on the money side. something is not right about this story, cheryl. i don't know what it is.

leland: fox news alert. we're just about 30 minutes away from update from the national hurricane center that will come at the top of the hour at 11:00 a.m. eastern as hurricane arthur makes its way up the east coast, threatening july 4th plans for millions of americans. you can see the track there on the right. arthur is now a category one hurricane with watches and warnings in effect from virginia up the eastern seaboard to maine. it made landfall last night in north carolina at as a category 2 storm. see damage on the left. it has winds topping 100 miles an hour. cheryl: firefighters gaining ground in containing a wildfire raging in southern california. evacuations have been canceled but officials warn this fire is still a threat. at least two homes already burned and many more are in

danger this is one of several fires burn thing in the region. dominic di-natale live from los angeles. what is going on? every summer we get fires in california but what is happening with these folks fighting the fires today? >> reporter: well, you know it is not just this summer proven to be bad. in fact the last wildfire season actually never stopped from 2013 going onwards. in san diego county today they're very much feeling that. 100 mountain homes under threat from the flames. crews are battling those. this is exactly where we saw a raging fire last year. this is the near the mountain town of julian. 150-acres in size is the banning fire erupted yesterday morning, cheryl. it is a couple hundred firefighters are dedicated to battling that particular blaze. we had evacuations of 200 homes. just 15% of it is contained. residents say, well, we've had a lot of close calls. >> i've been through this

before. so it is not a good feeling to think you're looking at your house for the last time. >> we've gone through this before. we've been here 15 years. this is always a trauma for everybody when you see a wisp of smoke. >> they dropped right on the house, which probably saved it. they came across this line here several times. so that was great. >> reporter: now in northern california the so-called butts fire in napa county is getting closer to containment. it is 4300 acres in size at the moment. some residents are allowed to return to their homes. we had better weather in the past couple days and that helped better containment, get better containment lines. cheryl: dominic this, is 4th of july weekend. what kind of precautions telling authorities to take this weekend? >> reporter: quite a few actually. first of all, start off with the cookouts and barbecues that you're having at home. make sure you put coals out. if that is what you're yoursing instead of gas.

cutting-edge double arm transplant at brigham and womens hospital in boston. he was serving in afghanistan when he became a quadruple amputee on may 24th, 2010. >> we were doing a knock and greet mission, kind of knocking on everybody's door and saying, we're the marines. we're here to protect you. turned to help you. turned around to my sergeant, took a step with my left leg and just a loud sound. just, couldn't hear after that. i was instantaneously triple amputee. i could feel this immense amount of pain and burning and just, like, yep, this is it. i don't want to die here. i can't die here. wake up, 2 1/2 months later in bethesda naval. found out, flat-lined three times. once was pronounced dead. had over 28 surgeries. >> reporter: john peck has come a long way since he was first injured.

in fact before he was put on the transplant list, he wants to get married which he plans to do on november 1st to his fiance, stacy, who he match on match.com two years ago. stacy is an icu nurse. she has three children which john adopted as his own. he is learning to walk on prosthetic legs. before he walks however, he wants to, he wants to know that he will be able to stand there when he walks her down the aisle. which, and you wouldn't think it would be so hard to stand which john has already gone skydiving. standing still on a prosthetic is the hardest part he tells me for any amputee. walking and moving is easy. john wants to stand still at altar when he puts the wedding ring on the stacy's finger. they are not asking for wedding gifts. they're asking wedding guests to donate to wounded veteran charities that helped them most. we'll have a full story on
